Welcome to ticoscoffee.com (the “Site”), operated by Nature Boy Coffee, Inc. dba Tico’s Coffee Roasting Co. (“Tico’s,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site, including any purchases, subscriptions, or other services we provide.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You must be at least 18 years old to use the Site. You agree to use the Site only for lawful purposes and in accordance with these Terms.
We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the new Terms. We will post the updated date at the top of this page.
2. Products and Orders
We offer small-batch roasted coffee, subscriptions, accessories, and related products for sale on the Site, including a wholesale (“WS”) section for business customers.
All prices are in U.S. Dollars (USD) and do not include shipping or applicable taxes, which will be calculated at checkout.
We reserve the right to limit quantities, refuse orders, or cancel orders that appear fraudulent or in violation of these Terms.
Product descriptions and images are for illustrative purposes. Actual products may vary slightly due to the nature of roasted coffee.
Subscriptions: Subscriptions automatically renew at the selected interval unless canceled before the renewal date. You may cancel or modify your subscription at any time through your account or by contacting us. Cancellation will take effect for the next billing cycle.
3. Payments
We accept major credit cards and other payment methods as displayed at checkout. By placing an order, you authorize us (or our payment processor) to charge your payment method for the total amount, including taxes and shipping.
All payments are processed securely. We do not store full credit card details on our servers.
4. Shipping and Delivery
We ship within the United States (some restrictions may apply; contact us for details on international, Hawaii, Alaska, or other locations). Shipping times are estimates only and are not guaranteed.
Due to the perishable nature of roasted coffee, we recommend consuming products within a reasonable time after receipt for optimal freshness. We are not responsible for changes in flavor after delivery or for issues caused by improper storage or brewing.
5. Returns and Refunds
Because coffee is a perishable food product, all sales are final unless the product arrives damaged or defective due to our error.
If you receive damaged or incorrect merchandise, contact us within 7 days of delivery at hello@ticoscoffee.com with your order number and photos if possible.
We will review the issue and, at our discretion, offer a replacement, refund, or store credit.
Return shipping costs are the customer’s responsibility unless we authorize otherwise.
Opened or partially used bags generally cannot be returned due to food safety and freshness considerations.
Subscriptions and sale items may have additional restrictions.
6. Charity Donations
We proudly donate 10% of our online sales to non-profit organizations. The specific non-profits are chosen by Tico’s at our sole discretion (Tico’s choice). There is no nomination process for charities. Donations are made periodically at our discretion. This is not a direct tax-deductible donation through your purchase; any tax benefits are determined by your own tax situation and the receiving non-profit.
7. Intellectual Property
All content on the Site, including text, images, logos, product descriptions, and trademarks (such as “Tico’s Coffee Roasting Co.” and related marks), is owned by or licensed to Nature Boy Coffee, Inc. dba Tico’s Coffee Roasting Co. and protected by U.S. copyright and trademark laws.
You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission. You may print or download pages for personal, non-commercial use only.
8. User Accounts and Conduct
If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activities under your account. Notify us immediately of any unauthorized use.
You agree not to:
Use the Site for any unlawful purpose.
Post or transmit harmful, abusive, or infringing content.
Scrape, data-mine, or use automated tools to access the Site.
Resell products purchased from the Site without our express written permission (particularly relevant for wholesale inquiries).
9. Disclaimers and Limitation of Liability
The Site and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Site will be error-free, uninterrupted, or secure. We are not responsible for any loss or damage resulting from your use of the Site, reliance on product information, or consumption of our coffee (including but not limited to allergic reactions, improper brewing, or storage issues).
To the fullest extent permitted by law, our total liability to you for any claim arising out of or related to these Terms or your use of the Site shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Nature Boy Coffee, Inc. dba Tico’s Coffee Roasting Co., its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your use of the Site.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Oregon, without regard to conflict of laws principles.
Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Marion County, Oregon. You consent to the personal jurisdiction of such courts.
12. Miscellaneous
If any provision of these Terms is held invalid, the remainder shall continue in full force. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and us regarding the Site.
We reserve the right to terminate or suspend access to the Site at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or to us.
